Assistant Counsel Pennsylvania Department of Education in Harrisburg

Focusing in the area of Special Education, with responsibilities that include, but are not limited to, the following:

* Providing guidance and counsel to the Bureau of Special Education in the Department of Education’s implementation of the Individuals with Disabilities Education Act, the Rehabilitation Act of 1973, the implementing regulations of both of these statutes, and state special education laws;
* Assisting in the development of state special education statutes and regulations;
* Providing advice and guidance to the Director of the Bureau of Special Education, Regional Division Chiefs and Special Education Advisors in the Department’s investigation and resolution of complaints filed by pursuant to 34 CFR §300.151-§300.153;
* Serving as liaison counsel in special education related litigation involving the Department or its employees;
* Reviewing policy statements, forms and training materials utilized by the Bureau of Special Education to ensure compliance with applicable federal and state laws;
* Providing legal guidance regarding issues arising from annual compliance monitoring of school districts or the review of local education agency special education plans;
* Providing legal guidance to the Bureau of Special Education in issues surrounding the assessment of students eligible to receive special education, including the determination of the types of accommodations that may be utilized in such testing and the attribution of scores of students eligible to receive special education; and
* Assisting the Bureau of Special Education in issues arising from the implementation of the School Based Access Program (SBAP), a program that permits local education agencies to seek Medicaid reimbursement for costs incurred in the provision of special education and related services to eligible students.
* Corresponding and communicating with the staff from the U.S. Department of Education’s Office of Special Education Programs as necessary.
